Instructions for the S&G staff member completing this checklist: 1. Mention to the person on the phone (the "intermediary") that, for ethical reasons, we prefer to speak directly to the person whose Will we are preparing (the "end client"). Ask if they're available to speak to you. 2. If they're not available, ascertain why (eg are they overseas, are they physically or mentally incapacitated, do they have problems speaking English, are they simply shy, etc?). Also, ascertain what authority the intermediary has to represent them (eg is the intermediary the end client's spouse, parent or child?). 3. If you can't speak to the end client and the intermediary still wants to proceed with the checklist, use your judgment to determine whether that is appropriate. 4. If you decide it is appropriate, mention to the intermediary that, while they can complete the checklist to determine if a phone Will is suitable for the end client, we will need to speak directly to the end client when we come to prepare their Will. Answer the next question below 'Yes' to continue this checklist. 5. If you decide it is NOT appropriate, depending on the reasons, consider making an appointment for the end client to see an estate planning lawyer in their local S&G office. Answer the next question below 'No' to cancel this checklist. 6. If you do get to speak to the end client, go back and change the client's name and the answer to the question immediately above to 'Yourself'.
